1. Introduction and Agreement to Terms

IMPORTANT NOTICE: These Terms contain an arbitration agreement and class action waiver that affects your legal rights. By agreeing to these Terms, you agree to resolve all disputes through binding individual arbitration, which means you waive your right to a jury trial and to participate in a class action lawsuit.

4. Investment Risks

Users are not permitted to maintain multiple personal accounts. Institutional clients or individuals managing investments on behalf of others may request permission to maintain multiple accounts through our Multi-Account Management solution, subject to additional verification and compliance requirements.
6. Privacy and Data Handling

This includes analyzing your financial information, investment preferences, and transaction history to optimize your investment strategy. Your data may be processed using neural networks, machine learning algorithms, and other advanced analytical techniques.

We implement advanced security measures to protect your data, including 256-bit AES encryption, secure data centers, and strict access controls. However, no method of electronic transmission or storage is 100% secure. 8. Payments and Fees

Our fee structure is based primarily on performance, with a 20% fee on profits generated. We do not charge management fees or hidden charges. Specific fee arrangements for each investment plan will be clearly disclosed before you make an investment.
8.2 Payment Methods
We accept various payment methods, including bank transfers, credit/debit cards, cryptocurrencies, and e-wallets. Processing fees may apply depending on the payment method used. These fees will be disclosed to you before the transaction is completed.
8.3 Deposits and Withdrawals
Deposits will be credited to your account after they have been confirmed according to our processing times, which vary based on the payment method. Withdrawals are subject to verification procedures, processing times, and any applicable minimum withdrawal requirements. Early withdrawal fees may apply if you withdraw funds before the end of your investment term.
8.4 Taxes
You are solely responsible for determining and paying all taxes applicable to your investments and any profits earned through our Services. We may provide tax documentation where legally required, but we do not provide tax advice. You should consult with a tax professional regarding your specific tax obligations.
9. Disclaimers
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMULATION INTELLECT EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
9.1 No Guarantee of Returns
We do not guarantee any specific investment results or returns. All projected or historical return figures are estimates and are not guarantees of future performance. Investment performance depends on various factors, including market conditions that are beyond our control.
9.2 No Guarantee of Availability
We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free. Technical issues, maintenance, market conditions, or other factors may cause the Services to be temporarily unavailable or operate at reduced functionality.
9.3 Third-Party Services
Our Services may integrate with or link to third-party services, applications, or websites. We do not control and are not responsible for the content, privacy policies, or practices of any third-party services. Your interactions with these third-party services are governed by their own terms and policies.
9.4 Information Accuracy
While we strive to provide accurate information, we do not warrant that any content provided through the Services is accurate, complete, reliable, current, or error-free. Market data and other financial information may be delayed or contain errors or omissions.
10. Limitations of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SIMULATION INTELLECT, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICES.
10.1 Limitation Amount
In no event will our aggregate liability for all claims related to the Services exceed the greater of the amount you have paid us in the past twelve months or $500.
10.2 Investment Losses
We are not liable for any investment losses you may incur as a result of using our Services, including losses due to market conditions, algorithm performance, technical issues, or any other factor affecting investment returns.
10.3 Jurisdictional Limitations
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain damages. Accordingly, some of the above limitations may not apply to you. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.
11. Termination
11.1 Termination by User
You may terminate your account at any time by following the termination procedures provided in the Services or by contacting our support team. Termination will be subject to settlement of any ongoing investments, payment of applicable fees, and completion of withdrawal procedures.
11.2 Termination by Simulation Intellect
We reserve the right to suspend or terminate your access to the Services at any time and for any reason, including but not limited to violation of these Terms, suspected fraudulent activity, regulatory concerns, or business necessity. We will provide notice of termination when reasonably possible.
11.3 Effect of Termination
Upon termination, your right to access and use the Services will immediately cease. Any provisions of these Terms that by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
11.4 Asset Recovery
Upon termination, we will process the return of your available balance according to our standard withdrawal procedures. Ongoing investments may need to be liquidated in accordance with their specific terms, which may include early withdrawal fees or waiting periods.
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
12.2 Arbitration Agreement
Any dispute, controversy, or claim arising out of or relating to these Terms, including their validity, interpretation, breach, or termination, shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in New York City, New York, and shall be conducted in English. The decision of the arbitrator shall be final and binding.
12.3 Class Action Waiver
You agree to resolve any disputes with Simulation Intellect on an individual basis only. This means you waive any right to bring or participate in a class, collective, or representative action against Simulation Intellect.
12.4 Exceptions
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights pending the completion of arbitration. Small claims disputes may be brought in the small claims court where jurisdiction and venue are proper.
13. Changes to Terms
13.1 Modification Right
We reserve the right to modify these Terms at any time in our sole discretion. If we make material changes to these Terms, we will provide notice through the Services, via email, or by other means to provide you with the opportunity to review the changes before they become effective.
13.2 Continued Use
Your continued use of the Services after the effective date of any modified Terms constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Services.

An archive of prior versions of these Terms is available upon request. The effective date of these Terms is stated at the beginning of this document.
